The following terms and conditions of use and any amendments thereto (the "Privacy.ca Terms") apply to your access to, and use of, the Privacy.ca feature offered by one of our affiliated Registrars (the "Registrar"). These Privacy.ca Terms may be changed in the future without further notice, and your continued use of the Privacy.ca Service following any such changes constitutes your acceptance of the new terms. These Privacy.ca Terms do not alter in any way the non-conflicting terms or conditions of this Agreement or any other agreement you may have with the Registrar for products, services or otherwise. To the extent any of the Privacy.ca Terms are in conflict or inconsistent with any other term or condition of the Agreement, these Privacy.ca Terms shall govern to the extent of the conflict or inconsistency.
1. PRIVACY SERVICE. The Privacy Service, when enabled, prevents publication of the Registrant’s technical and administrative contact information in a WHOIS query. The technical and administrative contact information of the Registrant is that of the Chief Privacy Officer of Privacy.ca. Privacy.ca is not the Registrant of the registered domain name.
2. GOOD FAITH. You hereby agree that by enabling the Privacy.ca feature for the domain name during the registration process, you will use the domain name and associated websites in good faith. Any alleged misconduct in connection with your use of the domain name will be subject to termination of the Privacy.ca Service in accordance with section 4 of these Privacy Terms.
3. TERM OF SERVICE. Unless otherwise specified, the Privacy service is for the duration of your domain name registration with one of our affiliated Registrars. The Privacy.ca Service will be automatically renewed with your agreement with the Registrar. Any renewal of your service with us is subject to our then current terms and conditions and payment of all applicable service fees at the time of renewal.
4. DISCLOSURE & TERMINATION. During the term of this Agreement, you agree that in the event Privacy.ca is threatened, receives a complaint, notice of action or any demand from a third party against Privacy.ca, its owners, directors, officers, shareholders, employees or partners and affiliates of Privacy.ca or where there is alleged infringement, abuse, misuse of the domain name and associated websites for which the Privacy.ca service is activated, you have provided us prior consent to disable the Privacy.ca service and to disclose your contact information, including your name, address, telephone number, email address and any such technical or administrative contact you have provided during the registration process to the complainant or third party requesting the information and making such information publicly available for a WHOIS query. You agree that neither prior authorization nor approval from you or your agent is necessary for such disclosure. In order to prevent you from enabling the Privacy.ca feature, we may, at our sole discretion, and without notice to you, prevent access, disable and/or terminate your account. You further agree that Privacy.ca may, without prior notice, at its sole unfettered discretion, (i) terminate this agreement and/or (ii) immediately disable any and or all Privacy.ca services.
5. ACCURATE INFORMATION. As further consideration for the Privacy Service, you agree to:
5.1 provide certain current, complete and accurate information about you as required by the domain name application process;
5.2 maintain and update this information as needed to keep it current, complete and accurate; and
5.3 respond within five (5) calendar days to a request by us to update or confirm the accuracy of your information.
We rely on this information to carry out our service for you and comply with the requirements of the registries of domain names and to send you important information and notices regarding your account and our service. Any failure by you to provide or update such information or to respond to our request is a material breach of this Agreement.
